The defendant
In criminal it happens when the government files a case in court to punish someone for committing a crime. If the defendant is guilty, he or she may be jailed while in the civil cases one business person or agency sues another one because of a dispute between them. If one loses a civil case it can be ordered to pay a fine to the other side but they won’t be jailed for loosing.
In criminal case the charges misdemeanor. If the defendant cannot afford a lawyer, the court will appoint one without a cost while in civil cases a party cannot afford a lawyer, they have to represent themselves.
In a criminal case, the government must prove the defendant’s guilty while in the civil case the plaintiff must proof his or her case by an evidence. This means that a party to a civil case can win if they are able to convince the judge.
In criminal case, defendants have the right to a trial except in infraction cases while in civil matters there is a wide variety of the cases where this no right to a trial.
In criminal case only the federal or the state government will have to state a case while a civil case begins when a plaintiff claims that another person has failed to carry out a legal duty.
