Abstract

Being the 21st Century, knowledge has increased and new technologies are emerging left, right and center. Almost each new day we wake up to a new trend, this means there is more information flowing through those new systems, and this information is vulnerable to a breach.Many government institutions, companies, and individuals are facing the risk of a data breach exposing their most valued personal information of their partnership, customers and employees.

The trend has been significant in the last two decades (2000- 2019) and it seems to take a new twist each and every day. Every now and then we wake up to news of a new breach across the globe. This article examines the new ways that lead to current data breaches in government institutions, companies and individuals. It also examines the legalities surrounding such methods.

It looks at how data breaches have been taking place since the last decade up to now, the technology involved, the response and finally the legal issues such as penalties accompanied by the breaches. Nevertheless, it looks at ways government institutions, companies and individuals have emerged out of such breaches, the reaction or rather responses taken and fines imposed. On the legal side, it looks at the action taken to mitigate such risks due to the fear of facing legal tussles in court.
