Discussion Assignment #2 – Employment Law (7.5%)

The operation of a workplace invariably creates employment law issues. For this discussion post:
Conduct research to find a Canadian workplace event that raised either (1) an unjust dismissal dispute (firing), (2) a dispute over the amount of notice to be given to an employee(s) that was being terminated (not fired) or (3) a human rights issue.
In your post, summarize your research on the event.
Using the legal concepts you have learned, discuss: how the dispute or issue could have been avoided in the first place?
What remedy do you think would be appropriate – support your analysis with legal concepts covered in the textbook.
Termination and firing are two different things.
Termination is when the employee is let go for which is not their fault and will be giving a reasonable notice of termination date or cash instead of reasonable notice (Part of the Implied Term act) e.g the employer can no longer afford its employees, or the department is shutdown etc.
Firing is when an employee is let go for doing something wrong that provided just cause (Part of the Implied Term act). They are not owed anything and that can be effective immediately
